He submits that he would have been promoted as Draftsman Grade I, in case he was not directly recruited to that post. Petitioner claimed that he was eligible for appointment as Draftsman Grade I, by promotion also, on completion of 10 years in the post of Work Superintendent Grade II and that he was entitled to higher grade in the scale of pay of Draftsman Grade I.

In the absence of qualified Work Superintendents Grade I, promotion in their quota can be made from Work Superintendents Grade II with 10 years service having the qualification for direct recruitment.

Appointments in the Water Authority were governed by the Special Rules for Kerala Public Health Engineering Subordinate Services, according to which appointment to the post of Draftsman Grade I is made by promotion from the post of Draftsman Grade II, promotion of Work Superintendent Grade I and by direct recruitment in the ratio of 5:2:3.
